| MINIMUM WAGES AND OVERTIME Wage and hour litigation is a specialty of Cook Kitts & Francuzenko, PLLC. Our lawyers have litigated dozens of FLSA cases within this niche specialty. We have litigated cases on behalf of individual plaintiffs, as well as on behalf of entire classes of employees in collective actions. Our lawyers have also represented a wide range of individual and corporate defendants in FLSA litigation. While the minimum wage and overtime requirements of the FLSA are simple on their face, the body of law and regulation constituting the exemptions to the Act are convoluted and technical. Moreover, defendants bear the burden of proof in asserting an exemption defense to a plaintiff's FLSA claim. Founding partner Zach Kitts is the author of the commentary to the FLSA sections in the United States Code Service (29 U.S.C.S. §201 et seq.) published by LexisNexis, and is a frequent speaker at Continuing Legal Education Seminars on topics related to the FLSA.
